Introduction

Welcome to the Cross Cultural Community Services (CCCS) website. These Terms and Conditions (“Terms”) govern your use of the CCCS website and any content, services, or transactions offered through it. By accessing or using our site, you agree to abide by these Terms. If you do not agree, please do not use the site. We may ask you to explicitly agree to these Terms when registering for certain services (e.g. webinar accounts). These Terms apply in addition to any specific agreements for paid consulting or training services, and if there is a conflict, those specific agreements will prevail.

Services and Content Offered

Educational Resources: Our website provides educational and informational content on topics such as
racial literacy, health equity, assimilation and acculturation, white allyship, psychological safety at work, and related subjects. This includes one-hour webinar sessions, toolkits (e.g. the Black History Month Community Wellness Fair Toolkit), and information on training programs (like our five-part EDI training series). All such content is provided for general knowledge and awareness purposes.


Consulting Services: We describe our organizational assessments, DEI consulting, and strategic guidance
offerings for institutions looking to improve cultural competency and equity practices. Any actual consulting or training engagements will be governed by separate contracts or agreements.


Event Registration: The site enables users to register for CCCS-hosted events (such as racial literacy
courses, wellness fairs, and webinars). When you register for events or courses through our site, you may
be required to provide certain information and complete payment (for paid events). All event registrations are subject to availability and any specific terms provided at signup (e.g. deadlines, codes of conduct for
attendees, etc.).


Informational Content: We also publish news updates, community impact stories, staff biographies,
organizational mission and values, historical background, and other informational content to promote
transparency and trust. This content is for informational purposes and does not constitute professional
advice or endorsements, unless explicitly stated.


Service Availability: Our services and content are primarily focused on users and communities within the
United States (especially Maine). We make no representation that the content or services on this site are
appropriate or available in other locations. If you access the site from outside the U.S., you do so on your
own initiative and are responsible for compliance with any local laws and regulations. We reserve the right to limit the availability of the site or any service to any person or geographic area at our discretion.

Accessibility Commitment: CCCS is committed to inclusive design. We strive to make all text, images,
videos, and interactive features on our site accessible to users of all abilities. If you have a disability and
encounter any barrier to access on our website, please notify us with a description of the issue. We will take reasonable steps to address accessibility problems and improve the user experience for everyone.

User Accounts and Registration

Most areas of our website are open for browsing without an account. However, if you wish to register for and purchase access to webinars or certain events, you will need to create a user account. When creating an account, you agree to provide truthful, accurate, and up-to-date information. You may be required to choose a password, and you are responsible for maintaining the confidentiality of your account login credentials. You must not share your password or account access with others, and you are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or a security breach, you must notify us immediately.

By creating an account or making a purchase on our site, you represent that you are at least 18 years old. The site and its services are intended for adult users. While general informational content on the site is not age-restricted, CCCS does not allow unsupervised use of interactive features (like event registrations or account creation) by minors. Children under 13 are not permitted to create accounts or submit personal information through the site, in compliance with the U.S. Children’s Online Privacy Protection Act. We do not knowingly collect personal data from children under 13, and if we become aware of any such data, we will delete it promptly.

We reserve the right to refuse registration, cancel accounts, or revoke access to paid content if these Terms are violated or if we deem it necessary to protect our interests or other users. After an account is terminated (by you or by us), you agree not to attempt to create a new account without our permission.

Fees, Payments, and Donations

Certain services on the CCCS website are fee-based. For example, attending our one-hour educational webinars or enrolling in training sessions will require payment of a registration fee. The pricing for these services is disclosed on the site (e.g. on event pages or our rate sheet) and is subject to change. By purchasing a webinar or other paid service, you agree to pay all applicable fees and taxes. Payments are processed through our designated payment providers. You must provide valid payment information, and you authorize us (or our third-party processor) to charge the fees to your selected payment method. All fees are in U.S. dollars unless stated otherwise.

No Subscription Required: There is no ongoing subscription required for general use of the site. Paid events or services are one-time or as contracted. You may opt-in to receive our email newsletters or updates, but that is voluntary and can be unsubscribed at any time.

Donations: As a nonprofit organization, CCCS may solicit donations or host fundraising campaigns on or through the website. Donations are entirely optional and, when made, are considered charitable contributions to support our mission. No goods or services are promised in exchange for general donations (aside from possible acknowledgment or tax receipts). Donations are typically non-refundable. We encourage donors to ensure they intend to donate the amount before completing the transaction. Any specific donation campaigns or sponsorship agreements may have additional terms, which will be provided when applicable.

Refunds and Cancellations: For paid event registrations (such as webinars), our general policy is that fees are non-refundable once the purchase is complete, except in cases of event cancellation or as required by law. If CCCS cancels or significantly changes a paid event, we will provide a refund or credit options to affected registrants. For consulting or training services contracted outside the website, any cancellation or refund terms will be governed by the service agreement with the client.

Acceptable Use and Conduct

By using the CCCS website, you agree to do so in a manner consistent with its intended purpose and in compliance with all applicable laws and regulations. You must not misuse the site or its services. Specifically, you agree NOT to:

  • Use the site to engage in any unlawful, fraudulent, or malicious activity.

  • Post or transmit any material that is defamatory, harassing, obscene, or otherwise objectionable (not that our site currently allows public posts by users, but this applies to any communications you send via forms or forums that may be added).

  • Introduce or distribute viruses, malware, or any harmful code that could damage the site or affect other users.

  • Attempt to gain unauthorized access to any portion of the site, other users’ accounts, or any systems or networks connected to the site.

  • Use any automated system (such as bots, scrapers, or spiders) to access or extract data from the site, except in accordance with our site’s robots.txt file or with prior written permission.

  • Interfere with the normal functioning of the website or take any action that imposes an unreasonable load on our servers.

Engaging in any activity that disrupts or harms the website’s performance or accessibility is strictly prohibited. If you violate the Acceptable Use provisions, CCCS may terminate your access to the site and pursue other remedies as described under Termination below.

Intellectual Property Rights

Unless otherwise noted, all content on the CCCS website – including text, graphics, logos, images, videos, webinars, toolkits, and downloadable resources – is the intellectual property of Cross Cultural Community Services or its content licensors. We own and control all copyright and other intellectual property rights in the website and the materials displayed on or accessible through it. All rights are reserved under applicable intellectual property laws.

Permitted Use: You are authorized to access and use the content on our site for your personal, non- commercial purposes, or your organization’s internal educational use. For example, you may download a resource toolkit for your own community event planning, or take notes during a webinar for personal learning. You may also share links to our website pages.

Prohibited Use of Content: You may not reproduce, distribute, modify, or create derivative works of any content from our site for commercial purposes without our prior written consent. This means you should  not, for instance, copy portions of our webinars or toolkits and publish them as your own work, or sell our educational materials. If specific content on the site is made available under a different license (for example, if we explicitly label a document as shareable under certain conditions), you must adhere to those terms. Otherwise, nothing on the site should be interpreted as granting any license or permission to use our intellectual property beyond what is stated in these Terms.

Trademarks: The name “Cross Cultural Community Services,” the CCCS logo, and any other trademarks or service marks displayed on the site are the property of CCCS (or other parties, in the case of partner logos or references). You are not permitted to use any CCCS trademarks without our prior written approval, except for nominal descriptive use or as allowed by law.

Note: We do not store full credit card numbers or sensitive payment data on our servers; that is handled by compliant third-party processors.

    • Messages and Inquiry Content: Any information you include when contacting us or submitting forms (for example, the text of a message, or specific questions you ask).

  • Usage Data: We may collect technical information when you use the site, such as your IP address, browser type, device information, pages visited, and time spent on the site. This is generally collected via cookies or analytics services and is not used to personally identify you.

  • Use of Personal Data: Any personal information you provide is used solely for the purposes for which it was collected or for related operational needs. For example, if you register for a webinar, we use your information to enroll you and send you access details. If you fill out a consultation form, we use your data to respond to your inquiry. We may also use your contact information to send you newsletters or updates if and only if you have opted-in to such communications (you can unsubscribe at any time). We do not sell your personal data to third parties, and we do not share it without your consent except as necessary to provide our services or as required by law. For instance, if you make a payment, your information will be shared with our payment processor for transaction processing (and that processor will have its own data protection obligations). If you sign up for an email list, your email might be stored with a third-party email service provider solely to send you Cross Cultural Community Services communications.

  • Data Security: CCCS takes reasonable measures to protect your personal information from unauthorized access or disclosure. We utilize standard security protocols and work with reputable service providers. However, no internet transmission or electronic storage is 100% secure, so we cannot guarantee absolute security. Users are responsible for maintaining the confidentiality of their own account credentials.

Indemnification

You agree to indemnify, defend, and hold harmless Cross Cultural Community Services, its officers, directors, employees, and agents from and against any and all claims, demands, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the website or services; (b) any content you submit, post, or transmit through the site (if such functionality exists); (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party. This means that if a third party makes a claim against CCCS because of something you did, you will be responsible for any costs or damages that we incur as a result, to the fullest extent allowed by law.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses. This indemnity obligation will survive the termination of your account or your use of the site.

Termination of Use

CCCS reserves the right, at its sole discretion, to suspend or terminate your access to the website or any portion of its services at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue or significantly modify the website. We shall not be liable to you or any third party for any such termination or modification of access. If your access is terminated due to a breach of these Terms, you may also forfeit any fees paid (for example, we will not refund a webinar fee if you are removed from the event or site for misconduct, unless required by law).

Upon termination, your right to use the site will immediately cease. The provisions of these Terms which by their nature should survive termination (such as intellectual property rights, disclaimers, limitation of liability, indemnification, and governing law) will continue in effect. If you wish to terminate your own account, you may do so at any time by contacting us or using any account cancellation features we provide. Note that terminating your account will not automatically delete data we have already collected, which may be retained in accordance with our Privacy Policy.

Additionally, CCCS reserves the right to take legal action or other remedies for any violations of these Terms. You agree not to attempt to circumvent any access restrictions or security measures on our site; any such attempts may result in permanent banning from the site and potential legal consequences.

Changes to These Terms

We may update or revise these Terms and Conditions from time to time. If we make material changes, we will post the updated Terms on this page with a new “Last Updated” date, and/or notify users by other appropriate means. It is your responsibility to review these Terms periodically for any changes. Your continued use of the CCCS website after any modifications to the Terms constitutes acceptance of those changes. If you do not agree to a revised term, you should discontinue use of the site.

Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Maine, USA, without regard to its conflict of law principles. All matters arising from or relating to your use of the website or these Terms that result in formal disputes shall be brought in the federal or state courts located within the State of Maine, and you hereby consent to the personal jurisdiction of such courts. We make no representation that the content on the site is appropriate or available for use in any particular location, and accessing the site from jurisdictions where its content is illegal is prohibited.

If any provision of these Terms is held to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of the Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in that or any other instance.

Any cause of action or claim you may have arising out of or related to the use of the site or these Terms must be commenced within one (1) year after the cause of action accrues, otherwise such claim is permanently barred, to the fullest extent permitted by law. (This one-year limitation may not apply in certain jurisdictions which do not allow shortening of statutes of limitation.)

Entire Agreement

These Terms and Conditions, along with our Privacy Policy (and any additional guidelines or terms provided for specific services or events), constitute the entire agreement between you and Cross Cultural Community Services regarding your use of this website. They supersede any prior agreements or understandings, whether written or oral, relating to the site. No amendment or waiver of these Terms by you will be valid unless in a writing hand-signed by an authorized representative of CCCS.
